As noted above, the OECD Commentary was amended in 2003 and 2005, whereas the United Nations Commentary had been last amended in the year 2001.

For that reason, it was suggested that the commentary be expanded to include specific references to international jurisprudence, which had repeatedly affirmed the principle of customary law contained in the draft article.

Paragraph 17 of the OECD Commentary, was amended in 2003.

Ms. Schmidt (Germany) proposed that the commentary should also make it clear, as suggested by the representative of the United States, that parties could not derogate from the mandatory provisions of domestic law.

The Chairman assured the representative of France that his views had been recorded and that the commentary would clearly state that the draft convention would not affect any mandatory requirement of domestic law.

While he was not opposed to a reference in the commentary to the long tradition of structured declarations in private law conventions, he was unable to support the proposed amendment to draft article 21.
