Force majeure excuses non performance for the time being, but a treaty is not automatically terminated by supervening impossibility at least one of the parties must decide to terminate it.

The doctrine of impossibility of performance, as codified in the Vienna Convention on the Law of Treaties, article 61, allows a State to terminate a treaty in the case of a permanent disappearance or destruction of an object indispensable for the execution of the treaty or suspend a treaty in the case of a temporary impossibility.
