The matter is now the subject of a criminal investigation.

The Court is establishing its operations in the field in connection with the situations under investigation.

The current reporting period coincides with the first phase of the investigation.

They should also, whenever possible, contact the respondents and collect their version of facts.

However, for such a multidimensional and complex case as the one under review, the investigation cannot be considered complete as of now.

Three States and the Security Council have referred situations to the Court, and three of those cases are under investigation by the Prosecutor.

In March 2001, however, the Spanish authorities ordered her to be arrested and detained in custody, during which time she was subjected to ill treatment.

During the mandate period, three cases of such violations were reported and investigated.

During this time, a large number of files were closed during the investigation period due to a freely negotiated settlement by the two parties.

3.6 On admissibility, the author submits that the same matter is not being examined under another procedure of international investigation or settlement and that he has exhausted all available domestic remedies.

This means that remand in custody must not only be lawful but reasonable and necessary in all the circumstances, for example to prevent flight, interference with evidence or the recurrence of crime.

It challenges the admissibility on the basis that the same matter is already being examined under another procedure of international investigation or settlement, for non exhaustion of domestic remedies and for non substantiation of their claims.

6.2 The Committee has ascertained that the same matter is not being examined under another procedure of international investigation or settlement for the purposes of article 5, paragraph 2 (a), of the Optional Protocol.

4.3 The Committee has ascertained, as required under article 5, paragraph 2 (a), of the Optional Protocol, that the matter is not being examined under another procedure of international investigation or settlement.

It is well established that the patient's chances of survival are greatest if they receive care within a short period of time after a severe injury however, there is no evidence to suggest that survival rates drop off after 60 minutes.

Adjustments should not be retroactively applied for any year preceding the inventory year subject to review, except in cases where recalculated estimates for previous commitment period years and or instances relating to paragraph 13 (c) below were submitted by the Party together with the inventory information of the inventory year subject to review.

Of course, most of what the government knows about you is known only in the sense that someone could get at it if they wanted to find out more about you or if your data matched some pattern that they were investigating.

4.3 The Committee has ascertained that the same matter is not being examined under another procedure of international investigation or settlement for the purposes of article 5, paragraph 2 (a), of the Optional Protocol.
