There is a breach of an international obligation by an international organization when an act of that international organization is not in conformity with what is required of it by that obligation, regardless of its origin and character.

This would entail that the present draft articles should not cover breaches of obligations under the rules of the organization.

On the basis of the foregoing remarks, four draft articles should consider the breach of an international obligation.

The preceding paragraph also applies in principle to the breach of an obligation set by a rule of the organization.

Since the State cannot make submissions on behalf of the accused, it would be tantamount to a breach of rules of natural justice for the Committee to express its views on the alleged violation, as there is no opportunity for the persons accused of the assault to give their version of the incident.
