Nomination of judges, co prosecutor and co investigating judge and their legal status

Their appointment is regulated by detailed procedures as set out (S.99).

The appointment of the first group of judges and prosecutors represented a big leap towards instituting reforms in the judiciary.

According to the author, the judiciary is directly controlled by President Obiang Nguema himself, who also has his say in the appointment of the judges.

The State party should guarantee the full independence and impartiality of the judiciary by establishing an independent body charged with the responsibility of appointing, promoting and disciplining judges at all levels and by remunerating judges with due regard for the responsibilities and the nature of their office.

The Judicial Service Commission appointed sub committees for each level of court, which prepared an opinion on the appointment and dismissal of judges.

5.4 By reference to Kazantzis v. Cyprus, the author submits that the procedure for appointing judges falls within the scope of article 25 (c) of the Covenant.
