Tugu was the insurance company that issued the policy to cover one of Magma's geothermal projects in Indonesia.

2.2 The author instituted proceedings against the company which had insured Mr. Sánchez Gea's vehicle in the court of Caravaca de la Cruz in order to obtain compensation for the death of her husband.

(c) It assigns a benefit of insurance of the goods in favour of the carrier or a person mentioned in Article 14bis.

Furthermore, Royal, as a member of the Dutch Association of Insurers, is expressly subject to independent disciplinary jurisdiction.

Following a well blow out, Magma claimed losses for US 12.5 mil from Tugu under the policy.

The seller made the sale conditional to the acceptance of the buyer by the defendant's credit insurance, which did not occur.

By letter dated 23 September 2002, Fair Insurance A S confirmed that the language requirement was necessary to obtain any insurance offered by the company for the following reasons

The insurance company VVAA Schadeverzekeing smattschappij (VVAA), with whom the author had third party insurance at the time of the accident, partially compensated the damage to Royal.

2.3 Royal filed a claim in the Utrecht Regional Court against the author and VVAA for compensation for the remaining damages.

Compensation for industrial injuries and ill health are covered by the Worker Compensation Act applying to those workers that fall outside the scope of the Provincial Employees Social Security Ordinance, 1965.

It sets out, in consultation with the insurer or agent involved, to find a solution to, or to pronounce an opinion on, an insurance dispute, but does not act in the place of the competent court.

My colleagues and I suggest a system in which compensation is provided by a third party (government, a charity, or insurance) with public oversight.

Two of the judges who considered this appeal, judges Herrman and Mijnssen, were at the time of the author's appeal, employed and remunerated by the Supervisory Board of the Insurance Sector (Raad van Toezicht Verzekeringen), which is financed by the League of Insurers (Verbond van Verzekeraars) of which Royal is a member.

6.6 Finally, inasmuch as the author's final claim is concerned, the Committee notes that the contention that some of the judges who heard the author's appeal might have been shareholders of the insurance company which litigated against him (Royal), was not raised in the course of the domestic judicial proceedings.

The letter also contained a response, dated 29 January 2003, from Fair Insurance A S to the Board, which stated as follows

3.4 Thirdly, the authorities should have examined whether Fair Insurance A S had any customers who were unable to speak Danish.

The petitioner argues that there may have been other reasons for the language requirement and refers to a test case conducted by a television show, which revealed that Fair Insurance A S offered insurance at a higher price to an individual of non Danish national origin than to a person of Danish national origin.

Activities include insurance and annuities, life insurance, retirement insurance, health insurance, and property casualty insurance.

2.2 The damage was covered by several insurance companies, including Royal Nederlands Verzekeing Maatschappij NV (Royal), which partially compensated the damage.

The Panel instructed the secretariat to forward each insurance policy submitted by the claimants in this instalment to the issuing insurer in Kuwait for verification.

The petitioner could have submitted that Fair Insurance A S had acted in contravention of the Act against Discrimination in its treatment of his insurance application and had thus also acted in contravention of good marketing practices .

2.2 In late July 2002, the petitioner contacted DRC, which requested confirmation of the petitioner's allegations from Fair Insurance A S.

He argues that a finding by these judges of the Supreme Court for the author in Royal's claim against him could have resulted in the termination of their membership on the Board and thus a loss of fees.
