If this condition is not fulfilled, the civil claim is inadmissible.

The court had to interrupt the adjudication twice to establish the mental capacity of one of the co accused.

(d) Consideration of the merits The consideration of the merits of a communication takes place in the light of all the information made available by the State party and the complainant.

The proceedings were resumed before the Pest Central District Court and were joined to another set of criminal proceedings pending against L.

In its ruling of 28 November 1996, the Commission took note of the withdrawal of the application and considered that there were no particular reasons in relation to the rights set out in the European Convention to examine the application further.

The civil matter on the distribution of the common property, on the other hand, has been suspended over the issue of registration for an undisclosed period of time.

The claim was dismissed.

In the circumstances of the present case for the reasons I have explained, there has been a diminution of the status of the applicants as they have not been emplaced to an existent organic post corresponding to the one previously possessed by them.

(i) The adjudication of the criminal case involving the applicant started on 10 April 2003. The first instance court judgement was delivered on 29 and 30 March 2004.

The author's procedural conduct also made further review of the case by the Court of Cassation impossible, as that Court would be restricted to a determination of whether it was within the power of the Appeals Court to dismiss the case on the inadmissibility ground advanced.

The State party contends that the progress of the proceedings was considerably hindered by the author's lack of cooperation with her then counsel and failure to submit the requested documents. Furthermore, it turned out that the couple's ownership of the flat had not been registered and that civil proceedings had been suspended in this connection.

As participation in the conciliation proceedings is voluntary and as the respondent refused to take part in the proceedings, the case was dropped and hence there was no decision on the merits.

In this case the complainant did not submit an appeal, and has thus not exhausted all the effective remedies available.

6.4 The State party notes that the fundamental rights case filed by the author in the Supreme Court remains pending, and that a violation of the same rights as those protected under articles 7 and 10, paragraph 1, of the Covenant will be considered in these proceedings.

Had they done this, the petitioners could have joined their action for criminal defamation to the criminal proceedings already under way against Mr. Sjolie. The petitioners could thereby have had an impact on the proceedings.
