This peculiarity arises in summary criminal proceedings.

Brazil is in favour of the referral of the situation in Darfur to the International Criminal Court (ICC).

The International Criminal Court received the referral of the situation in Darfur in the capacity of a well developed institution.

Yet, Brazil has always endorsed the authority of the ICC as the only acceptable international criminal institution to deal with the situation in Darfur.

It further recommended that the Security Council refer the situation in Darfur to the International Criminal Court.

The Commission strongly recommended that the Security Council refer the situation in Darfur to the International Criminal Court (ICC).

The referral by the Security Council this spring of the situation in Darfur to the International Criminal Court's Prosecutor and the opening of an investigation into that situation by the Prosecutor were other important milestones.

Significant changes in criminal policies and law enforcement practices have had a positive effect on the social, political and criminal justice situation in the country.

The referral of the situation in Darfur to the Court also demonstrates close cooperation between the United Nations and the International Criminal Court.

New legislation provided for civil compensation claims to be filed automatically at the time the criminal case was submitted to the court so as to ensure fast track compensation.

As members are aware, there is a clear recommendation from the International Commission of Inquiry on Darfur that the Security Council immediately refer the situation to the International Criminal Court.

That having been said, we believe that the resolution is a genuine and valid compromise leading to the very first referral of a situation to the ICC by the Security Council.

We wish to highlight the particular importance that we attach to the Security Council's decision, adopted in its resolution 1593 (2005), to refer the situation in Darfur to the ICC Prosecutor.

In its resolution 2003 24, the Economic and Social Council requested the Executive Director of UNODC to include in his annual report to the Commission on Crime Prevention and Criminal Justice information on the financial status of the United Nations Crime Prevention and Criminal Justice Fund.

The referral of the situation in Darfur to the International Criminal Court has brought an international, independent and impartial justice component to the collective international and regional efforts to end the violence in Darfur.

Encouragingly, as a result of the adoption of Security Council resolution 1593 (2005), on 1 June the Prosecutor of the International Criminal Court decided to open an investigation into the situation in Darfur.

The International Criminal Court is complementary to national criminal jurisdictions.

There is now a close and well established relationship between the International Criminal Court and the United Nations, as a result both of the adoption of a Relationship Agreement between the two organizations and of the Security Council's referral to the Court of the situation in Darfur.

(vi) Humanitarian situation. To evaluate the humanitarian situation.

To ensure accountability for the crimes committed in Darfur and taking into account the deficiencies of the Sudanese judicial system, the International Commission of Inquiry for Darfur recommended that the Security Council should refer the situation to the International Criminal Court.

Like others, Australia thinks it is appropriate to also take this opportunity to recognize the Security Council's decision, through its adoption of Council resolution 1593 (2005) on 31 March, to refer the situation in Darfur to the International Criminal Court for investigation.

(f) To continue to cooperate with the International Criminal Court and with the International Criminal Tribunal for Rwanda

The United Kingdom welcomes the Council's decision to refer the situation to the International Criminal Court, which is for us the most efficient and effective means available to deal with impunity and to ensure justice for the people of Darfur.

This limit on writing and speech is especially harsh, because it is punishable by imprisonment for up to two years, though here the criminal penalty applied was a monetary fine.

The entity criminal codes also envisage criminal offences of trafficking in people.
