Several speakers acknowledged the innovative nature of the Convention, especially because of the comprehensive chapter on preventive measures and the enshrinement of asset recovery as a fundamental principle.

The return of assets pursuant to this chapter is a fundamental principle of this Convention, and States Parties shall afford one another the widest measure of cooperation and assistance in this regard.

The Convention reflects a multidisciplinary approach and contains comprehensive provisions that cover prevention, criminalization, international cooperation, technical cooperation and, for the first time in an international legal instrument, asset recovery.

However, the Guide proposes that all types of asset are capable of being the object of a security right, including all present and future assets of a business, and covers all assets, both tangible and intangible, with the exception of assets specifically excluded.

Among the categories of intangibles are claims and receivables.

The law should provide that a secured creditor's priority with respect to an encumbered asset extends to the proceeds of the asset subject to the requirements of recommendation 54.
