(b) The amendments to the Family Act, the Criminal Code and the Criminal Procedure Act in 2003

Under section 6A of the Crimes (Biological Weapons) Act, Chapter 2 of the Criminal Code Act 1995 (the Criminal Code) applies in relation to these offences.

The package includes a transitional criminal code, a transitional code of criminal procedure, a transitional detention act and a model transitional police directive.

Entries 2 and 57 replace Act No. 88 by article 91 of the Criminal Code .

Chapter 2 (other than Part 2.5) of the Criminal Code applies to all offences against this Act.

It is important that an illegal act committed by a person is prescribed by the Criminal Code.

The Criminal Code Amendment (Trafficking in Persons Offences) Act 2005 came into effect on 3 August 2005.

Anyone who commits such an act shall be subject to the criminal penalties prescribed, inter alia, in the Penal Code and other criminal laws.

Moreover, the means of electronic surveillance can also be used in criminal proceedings according to Act No. 141 1961 Coll. on Criminal Proceedings (Code of Criminal Procedure) as amended.

By the provision of Paragraph 4 of Article 38 of the RA Criminal Code, the recruitment act itself would be considered as an act of incitement to carry out a terrorist or other criminal act, as the aim of recruitment is the involvement of persons in the commission of a criminal act.

The previous Criminal Code defines homosexuality as a criminal offence, while the new Criminal Code eliminates such a stipulation.

Changes had also been made to the Code of Criminal Procedure and the Hindu Succession Act to empower women further.

At present, the offence of rape under the Criminal Code is limited to an act committed by men against women.

Relevant Federal legislation includes the Quarantine Act 1908, the Crimes Act (Biological Weapons)1976, the Chemical Weapons (Prohibition) Act 1994, the Weapons of Mass Destruction (Prevention of Proliferation) Act 1995, the Criminal Code, and the Customs Act 1901.

Suppression of the financing of terrorism Criminalization of this act is included under the provision on the preparation of the criminal offence in the amended Criminal Code (Art. 7 collection of funds for a terrorist act means preparation for a criminal offence and Art. 10 provisions of funds for a terrorist act or procuring the means to aid this act).

(g) Harmonization unification of the criminal code and the penal code

Penal Code Act (Cap 135)

According to the new Article on Financing of Terrorism (Article 217) amended into to the Criminal Code, any person who finances an execution of terrorist act is subject to criminal liability.

The Criminal Law (Amendment) Act amends Sections 299, 302, 305, 308, 310, 311, 316, 324, 337, 338 of the Pakistan Penal Code (PPC) and Sections 345, 401 of the Code of Criminal Procedure (CrPC) to ensure more effective prosecution of cases of the so called honour killings.

The Criminal Law (Amendment) Act amends Sections 299, 302, 305, 308, 310, 311, 316, 324, 337, 338 of the Pakistan Penal Code (PPC) and Sections 345, 401 of the Code of Criminal Procedure (CrPC) to ensure more effective prosecution of cases of the so called honour killings.

(4) The act that is the grounds for the extradition request is not an offence in accordance with the Criminal Code of the Republic of Belarus

Criminal liability of legal persons will be provided for in the recodified Criminal Code.

Chapter 2 of the Criminal Code sets out the general principles of criminal responsibility.

For the mentioned crimes in the Penal Code and for terrorist crimes according to the Act on Criminal Responsibility for Terrorist Crimes, Swedish courts have universal jurisdiction.

If a person suspected in committing such an act appears to be on the territory of the Republic of Armenia, a criminal persecution will be initiated in the order prescribed by the RA Criminal Procedural Code.

Penal Code (Amendment) Act No. 17 of 2003.

Mr. Martínez Ramírez was charged with manufacturing, trafficking and carrying weapons and ammunition reserved for the exclusive use of the armed forces , a criminal offence under article 366 of Act No. 599 of 2000 (the Criminal Code).

Positive aspects The Committee notes with satisfaction the enactment of new legislation containing anti discrimination provisions, including the Criminal Code and the Code of Criminal Procedure.

By Article 14 of the Criminal Code the person who committed a crime, is subject to criminal liability in accordance with the Code, irrespective of his status.

The Criminal Code has provisions for punishing violence against women.

(f) The alleged reluctance of prosecutors to institute criminal proceedings under article 137A of the Criminal Code.

The Committee welcomes the Act of 19 July 1997, which supplements the Criminal Code by making racism a more serious offence and criminalizing revisionism and other acts based on discrimination.

The abovementioned provisions must be read in conjunction with the Penal Code Sections 147 a, which makes it a serious criminal offence to commit a terrorist act, and 147 b, which makes it a serious criminal offence to finance terrorism.

Likewise if a person has financed an act of international terrorism (Article 389), it will also be considered a criminal act, since the financing of the offence provided for by Article 389 will be considered as assistance to international terrorism according to Paragraph 5 of Article 38 of the RA Criminal Code.
