The proper implementation of the sanctions regime depends on Member States circulating the Consolidated List to all appropriate authorities.

The Council thereafter approved a regulation (No. 881 2002) to implement the sanctions, naming those on the Consolidated List.

The Consolidated List continues to serve as the foundation for the implementation and enforcement of the Al Qaida Taliban sanctions.

Sixty five Member States have said that sanctions cannot be implemented against certain entries on the List without sufficient identifiers.

Together with Germany, France intends to draw up a list of uncooperative countries and to design a tool kit of appropriate sanctions.

This annex does not contain any entries as the competent Security Council sanctions committee has not yet issued a list of names.

The Team regards the Consolidated List as the basis of the sanctions programme. It sees its credibility and relevance as essential to Member States' compliance.

Many Member States have pointed out that a significant number of names on the List have insufficient identifiers to allow proper enforcement of the sanctions.

Other cases have been filed or decided in several other countries that, while not challenging the sanctions, involve individuals or entities on the Consolidated List.

The mission subsequently received a briefing from the Chairman of the Group of Experts on its activities since the publication by the sanctions committee on 1 November of a list of individuals and entities subject to sanctions under resolution 1596 (2005).

Other cases have been filed or decided in the past six months that, while not challenging the sanctions, involve individuals or entities on the Consolidated List.

The Team's contacts with Member States suggest that commitment to the sanctions would be enhanced by greater relevance and accuracy in the List and a sense that the sanctions regime was dynamic in tracking the changing nature of the Al Qaida Taliban threat.

Such sanctions may include monetary sanctions.

This process should help the Committee to ensure that sufficient identifiers and other relevant information appear on the Consolidated List to permit States to enforce the sanctions effectively.

The list of sanctioned entities is attached as annex to Ordinance No. 707 2002 Coll. of the Slovak Government on international sanctions to safeguard international peace and security.

As provided by the resolutions, these Decrees provide for enforcing sanctions related to the Taliban and Osama bin Laden, including a specific list of designated persons and entities.

The Committee notes that 65 Member States have addressed the problem of sanctions not being implemented against certain entries on the consolidated list because there are insufficient identifiers.

The Team has also worked closely with the Committee and the Secretariat on the Consolidated List, which the Team sees as the key element of a successful sanctions regime.

The Committee is aware of the importance of the circulation of the consolidated list and that the proper implementation of sanctions measures depends on Member States circulating the consolidated list to all appropriate authorities, intelligence agencies, designated non financial entities and professionals as relevant.

The Team foresees a three part approach with respect to the Taliban list. First, the Government of Afghanistan should do what it can to provide full identifiers for the Taliban individuals on the List so as to allow better enforcement of the sanctions against them.

The U.S. Department of Treasury is easing sanctions on a list of services incident to the exchange of personal communications over the Internet or software necessary to enable such services.

The overwhelming majority of reporting States acknowledges the value of the Consolidated List as the basis of the sanctions, and all claim to have incorporated it into their legal systems.

Moreover, we cannot postpone the creation of a consolidated sanctions list of terrorists and terrorist organizations, regardless of whether or not they are associated with Al Qaida or the Taliban.

The key elements of the Security Council sanctions the Consolidated List, the assets freeze, the arms embargo and the travel ban continue to provide the basis for an effective regime.

The List also contains 20 entities with an address in Somalia, where there is no central authority capable of implementing the sanctions, nor a banking system able to freeze assets.

In practice, the Federal Council adopts an ordinance to implement each particular sanctions regime, including the United Nations Al Qaida Taliban list, with an annex listing the targeted individuals and entities.

Although the List, on which the sanctions regime depends, cannot be an exhaustive compendium of all Al Qaida associates, many Member States do not find it the useful tool it should be.

We hope that the resolution will consolidate the consensus recently forged among all parties on improving the quality of the comprehensive list, enhancing sanctions measures and encouraging more Members to submit lists.

At least four of these cases directly referred to the Consolidated List, alleging that the Council of the European Union and or the Commission of the European Communities had abused their respective powers by adopting regulations implementing the Security Council financial sanctions on individuals and entities on the List.

Sanctions Blowback

Monitoring of sanctions implementation by sanctions committees and monitoring mechanisms, in accordance with relevant Council resolutions, can increase the effectiveness of sanctions.

In addition, the report addresses two issues of concern to many States the need for greater fairness in the application of the sanctions, and the lack of sufficient identifiers on the Consolidated List.

Since the initial sanctions against the Taliban, the Consolidated List has evolved to include Osama bin Laden, members of the Al Qaida organization and the Taliban and other individuals, groups, undertakings and entities associated with them.

Instituting a process for reviewing cases of individuals and institutions claiming to have been wrongly placed or retained on the list of the Al Qaeda Taliban Sanctions Committee would be one important step in that direction.
