Turning to the question of domestic employees, she said that in 1995 the Labour Code had been reformed to guarantee domestic employees, including not only women but also men employed as drivers, gardeners, etc., at least 40 per cent of the minimum salary.

At the time, about 40 of the female labour force was employed as domestic servants for a very wide range of society, from the wealthiest to respectable working class families.

The Committee requested the Government to indicate how children working in domestic service who are not covered by the applicable legislation are protected against the worst forms of child labour.

Noting that under section 40 of the Labour Proclamation, the Minster of Labour and Human Welfare may determine the provisions of the Proclamation that shall apply to all, or to a category of domestic workers, the Committee asks the Government to indicate whether such a determination has been made.

In line with the Committee's general recommendations, Paraguay had amended its Civil Code, Labour Code, Electoral Code and Penal Code, which now defined sexual harassment and domestic violence as serious offences.

The new Labour Code would protect women against all physical and moral abuse, and the Penal Code would criminalize domestic violence, sexual harassment and any other kind of violence against women.
