Having received, in accordance with article 37 of the Provisional Rules for Claims Procedure ( the Rules ), the report and recommendations made by the D1 panel of Commissioners concerning the late filed category A and category C claims programme, covering 3,783 claims,

The thirtieth instalment of claims was submitted to the Panel on 11 August 2004, in accordance with article 32 of the Provisional Rules for Claims Procedure (S AC.26 1992 10) (the Rules ).

Decision concerning corrections of awards pursuant to article 41 of the Provisional Rules for Claims Procedure (S AC.26 Dec.254 (2005))

Thirty second report of the Executive Secretary pursuant to article 41 of the Provisional Rules for Claims Procedure (S AC.26 2005 13)

To approve corrections to certain category A, C and D claims contained in the thirty second report of the Executive Secretary pursuant to article 41 of the Provisional Rules for Claims Procedure (S AC.26 Dec.254 (2005)).

In addition, the Governing Council took decisions concerning the deadlines for the receipt of requests for correction pursuant to article 41 of the Provisional Rules for Claims Procedure.

It contains the recommendations of the Panel on the fifth instalment of F4 claims (the fifth F4' instalment ), and is submitted to the Governing Council pursuant to article 38(e) of the Provisional Rules for Claims Procedure (the Rules ) (S AC.26 1992 10).

Recalling that pursuant to articles 38 (a) and (b) of the Provisional Rules for Claims Procedure (S AC.26 1992 10), the Governing Council encouraged the adoption of consolidation and other administrative procedures to facilitate the resolution of nearly 2.7 million claims filed with the Commission,

Under article 40(4) of the UNCC Provisional Rules for Claims Procedure, the Governing Council's decision is final and is not subject to appeal or review on procedural, substantive or other grounds.

The fourthsecond group of overlapping claims initially consisted of E4 claims related to 39seven category C claims and 24 category C and D claims.

This procedure is called an orthotopic neobladder procedure.

Claims

4.2 Under article 788.6 of the Criminal Procedure Act, the records must reflect the essential content of the evidence examined, its impact and the claims to which it gives rise, and the decisions adopted.

The average number of loss types is 3.14 for the claims in this instalment, compared with 2.01 for all claims in the regular category D claims programme, 1.93 for Jordanian claims and 1.71 for Kuwaiti claims.

It further notes that apart from asking it to review the Dutch asylum procedure, the author's claims relate to procedural irregularities (see paragraph 3.2), which the domestic courts have not had an opportunity to address.

Duplicate claims

Concerning the issue of duplicate claims, the secretariat indicated that it was aware of the risk of duplicate claims from the outset of claims processing and took steps to identify and eliminate such claims during the course of claims processing.

He claims that this procedure does not respect Canada's obligations under international law or the Canadian Charter of Rights and Freedoms, owing to the absence of an independent decision making mechanism and a lack of impartiality.

It challenges the admissibility on the basis that the same matter is already being examined under another procedure of international investigation or settlement, for non exhaustion of domestic remedies and for non substantiation of their claims.

The Office of Internal Oversight Services report on the advisory services stated that, as the Office had informed UNCC in the past, there was no procedure within UNCC to take action against claimants filing false claims.

These E4 claims were considered in the second instalment of E4 claims.

Of these claims, the Panel recommends awards of compensation for two claims, while no awards are recommended for the remaining 16 claims.

The average amount claimed for the claims in this instalment is about USD 2 million, compared to about USD 820,000 for all claims, about USD 934,000 for Jordanian claims and about USD 861,000 for Kuwaiti claims in the regular category D claims programme.
