The Committee therefore considers that an application for amparo could not be effective with regard to the alleged violation of article 14, paragraph 5, of the Covenant, and that the author had exhausted domestic remedies in respect of the alleged violation.

Nor has she explained any link between this ground for exclusion and the alleged violation of article 18 of the Covenant.

In view of this finding, the Committee need not pronounce itself on the alleged violation of article 14, paragraph 3 (b).

4.2 The State party argues that domestic remedies were not exhausted in regard to the alleged violation of article 14, paragraph 3 (c), of the Covenant.

5.3 As to the alleged violation of article 14, paragraph 5, of the Covenant, the author emphasizes that he was first convicted by a court of appeal.

The nature of its mandate means that it can reach conclusions because the alleged violation concerns the application of a law the existence of which cannot be disputed.

4.6 The State party concludes that the alleged violation of article 14, paragraph 5, should be found inadmissible as constituting an abuse of the right to submit a communication.

7.2 The Committee observes that neither the author nor the State party has disputed the facts related in connection with the alleged violation of article 14, paragraph 5, of the Covenant.

At the hearing, the first author did not invoke the alleged violation of his basic rights, but awaited notification of the judgement in order to do so before the Constitutional Court.

In the application, the author alleged both violation of his right not to be compelled to testify against himself, given that the only evidence on which he was convicted was his acknowledgement of a debt to the company, and violation of his right to be tried without undue delay.

Pursuant to article 4, paragraph 4, of the Optional Protocol, the Committee finds that the facts alleged reveal a violation of article 10 of the International Covenant on Civil and Political Rights.

Consequently, also with regard to the alleged violation of article 14, paragraph 1, and article 26 of the Covenant, the communication is unfounded in accordance with article 3 of the Optional Protocol.

The author or authors of a communication or the individuals who are alleged to be the victim or victims of a violation of the rights set forth in the Convention may request that the names and identifying details of the alleged victim or victims (or any of them) not be published.

On that basis, the latter could request a copy of the investigation file and other documentation not merely relating to the alleged primary violation but also relating to the domestic examination of the issue.

If the State controls the infliction of the alleged violation and if it was or should have been foreseen that the applicant would be a victim of the act, the applicant is within the jurisdiction.

He also alleged that the appeal (cassation) did not fulfil the requirements of article 14, paragraph 5, of the Covenant, and that he was sentenced in violation of the principle of the presumption of innocence.
