This Act concerns forms of sexual harassment and abuse that are criminal offences.

On 1 July 1999 the Sexual Abuse and Sexual Harassment in Education Act came into effect.

What measures have been taken or implemented to combat sexual harassment at work? Are there any programmes to have stronger enforcement of the Labour Protection Act of 1998 or strengthen its sexual harassment provisions?

The Gender Equality Act establishes the duty of the employer to ensure that employees do not become victims of sexual harassment.

In 2000 the Working Conditions Act was evaluated with regard to sexual harassment, aggression, violence and bullying in the workplace.

The Division was also responsible for promoting understanding and acceptance of the Act and publishing guidelines on prevention of gender discrimination and sexual harassment.

In order to ensure stronger enforcement of the Labour Protection Act, and to strengthen the sexual harassment provisions, it is necessary that cases on sexual harassment at workplace be reported as well as directed to responsible organizations or agencies.

The policy paper also suggests that support be given to the State Law Office to draft a Sexual Harassment Bill as currently the Labour Act makes no provisions for curbing discriminatory practices related to sexual harassment in the workplace.

As for sexual harassment beyond the workplace, if the act is considered a rape, the defendant must be punished according to the Criminal Law.

Prevention of Sexual Harassment

The Law defines the situations amounting to harassment, i.e. sexual harassment.

Sexual harassment directives were prepared and distributed throughout the police force, a special sexual harassment overseer was appointed and reports on sexual harassment within the police and cases of inappropriate treatment due to harassment are published.

Further to the formulation of two European directives in the area of emancipation, a legislative proposal to include a ban on harassment in the Equal Treatment Act was submitted to Parliament.

In a direct request of 2004, the Committee noted with interest that section 19 of the Act on Violence against Women and the Family establishes sexual harassment as an offence punishable by imprisonment.

The competent authorities, educational institutions, and other legal agents will ensure effective mechanisms in protection against discrimination and sexual harassment and will not take any disciplinary or other punitive measures against that person because of the fact that he or she complained about discrimination, harassment, or sexual harassment, or testified about discrimination, harassment, or sexual harassment.

The Law on Equal Opportunities for Women and Men regulates the issue of harassment and sexual harassment as a form of discrimination.

They bar threats against, and harassment of, individuals.

Harassment of journalists in the exercise of their profession

A positive action for both would be for both sectors to support a comprehensive piece of legislation such as a Sex Discrimination Act or a Sexual Harassment Bill making illegal both direct and indirect discrimination.

Discussions had taken place on whether the Bill needed to be amended to include comprehensive provisions on sexual harassment or whether they should be incorporated into a new labour and employment act.

Harassment of NGO personnel also remains a serious concern.

The issue of sexual harassment is again quite complex and sensitive.

The newly drafted Labour Law introduced specific definitions of direct discrimination, harassment (including sexual harassment) and indirect discrimination in line with the recent case law of the European Court of Justice.

Recalling its 2002 general observation on sexual harassment, the Committee noted that under section 172 of the Labour Code of 10 January 1997 all forms of sexual violation (harassment) are strictly forbidden .
