Apart from the major contradictions noted above, such a thesis is alien to the spirit and substance of the Vienna Convention on the Law of Treaties.

This jurisprudence is consistent with the general thesis among many courts and commentators that treaties consistent with national policy during armed conflict should be upheld, since the treaties in question concern only private rights.
