Criminal Procedure Code

Specially, the Criminal Procedure Code was adopted with provisions to ensure better human rights protection in criminal proceeding.

Two Sections have also been added to the CrPC.

Those provisions have been incorporated into the Code of Criminal Procedure.

The Code of Criminal Procedure provides for special regulation for collecting evidence.

Moreover, the means of electronic surveillance can also be used in criminal proceedings according to Act No. 141 1961 Coll. on Criminal Proceedings (Code of Criminal Procedure) as amended.

Article 23 of the Code of Criminal Procedures of 2004 defines the procedures and conditions for instituting criminal proceedings.

On 1 July 2004, the new Code of Criminal Procedure entered into effect.

People are still being detained beyond the time limits established under the Code of Criminal Procedure.

The indicated standards of the Constitution are also realized in the Code of Criminal Procedure (article 9).

The application of the 2004 interim criminal procedure code has been particularly problematic.

(b) The amendments to the Family Act, the Criminal Code and the Criminal Procedure Act in 2003

The summary nature of the record is expressly provided for by article 743 of the Criminal Procedure Act.

Concerning the Code of Criminal Procedure, bank secrecy may not be invoked before a court.

The Criminal Procedure Code, 1898 provides for special treatment of women, when confronted with the law.

Transfer of criminal proceedings

Presumption of innocence applies to all citizens (articles 17 and 19 of the Constitution and article 8 of the Code of Criminal Procedure).

Under the Pakistan Penal Code, 1860, (PPC) severe penalties are prescribed for the offences of kidnapping or abduction of girls women under Sections 361, 363, 364A 369, procurement of a girl (Section 366A PPC) or her importation from abroad (Section 366B PPC).

Section 545 of the Criminal Procedure Code allows the court to provide compensation to victim of a crime from the fine imposed on the perpetrator of the crime.

The Qatari Code of Criminal Procedures devotes an entire chapter to international judicial cooperation, including the extradition of convicted and accused persons and the surrender of material objects.

The principles and procedures governing the interception of communications are stated in articles 21 and 166 to 171 of the Code of Criminal Procedure.

The initial inquiry agencies of the KGB detained Mr. Marynich pursuant to article 108 of the Criminal Procedure Code (detention on direct suspicion of the commission of an offence) and a criminal case was initiated against him on the basis of articles 295 (2) and 377 (2).

Thus, article 40 of the Code of Criminal Procedures stipulates that accused persons must be informed of their right to remain silent and to contact a person of their own choosing.

2.5 The Criminal Procedure Act, in its article 790.1, grants prosecutors advantages in terms of investigation that are not granted to the defence.

Legal procedures to protect the victims of criminal acts, witnesses or other persons assisting law enforcement agencies are provided for under the Code of Criminal Procedure.

If a person suspected in committing such an act appears to be on the territory of the Republic of Armenia, a criminal persecution will be initiated in the order prescribed by the RA Criminal Procedural Code.

According to the complainant, this was in contravention of articles 192 (3), 195 and 196 (3) of the Criminal Procedure Code (CPC), which deals with police powers of arrest and detention.

At each stage of indictment, trial and appeal, the Code of Criminal Procedure provides guarantees that vary according to the nature of the offence and the conditions established by law.

The Criminal Law (Amendment) Act amends Sections 299, 302, 305, 308, 310, 311, 316, 324, 337, 338 of the Pakistan Penal Code (PPC) and Sections 345, 401 of the Code of Criminal Procedure (CrPC) to ensure more effective prosecution of cases of the so called honour killings.
