Freeze the Settlement Freeze

The assets freeze is perhaps the most implemented of the sanctions on a global scale, and it may constitute the most effective mechanism to prevent large scale terrorist operations.

In resolution 1390 (2002), the Council outlined three principal measures an asset freeze (and related financial measures), an arms embargo and a travel ban.

If the State is able to determine on its own that it has a case of mistaken identity, then it should unfreeze the assets immediately.

The Law on the Fight Against Legalizing the Illegal Income and Financing of Terrorism provides the Central Bank with the authority to freeze financial assets or economic resources.

The variety of legislation used by States reflects different legal traditions, but also causes variations in the flexibility and practicality of asset freezing measures.

As well as the clear identification of the individual or entity subject to the measures, a full address is also a key to effective assets freezing.

The United States Congress is currently debating a law that would impose asset freezes and visa bans on the 60 people identified as having had some responsibility for Magnitsky's detention and death.

Additionally, resolution 1390 (2002) requires the freezing of funds and other financial assets without delay , but practical considerations may make this difficult.

Other countries, such as Pakistan, implement the assets freeze automatically after each United Nations listing on the basis of their original United Nations participation legislation.

In the interim report submitted in March 2005, the panel reported on the WAMCO contract, signed by the Minister of Lands and Mines Jonathan Mason, giving a monopoly over the purchase of diamonds to WAMCO without following any transparent competitive tendering process.

Another State requires banks and other relevant bodies to report to the authorities within 10 days of freezing the assets of listed individuals and entities.

Of the 32 States that continue to freeze assets, eight have provided up dates, seven in answer to enquiries from the Team and one during a Chairman's trip.

But while there have been further reports of assets freezing, the combination of sanctions has still not achieved its full potential and the Monitoring Team makes further recommendations for improvement in this report.

Please describe briefly the domestic legal basis to implement the asset freeze required by the resolutions above, and impediments under your domestic law in this context and steps taken to address them.

Based on their resolution 1455 reports, 117 States have a clearly identified legal basis to freeze assets or otherwise prevent the financing of terrorism.

In these systems, the State often has to present to a judge or enforcement authority sufficient evidence of a specific criminal offence to freeze (or maintain an emergency freeze) of assets.

The List also contains 20 entities with an address in Somalia, where there is no central authority capable of implementing the sanctions, nor a banking system able to freeze assets.

The Monitoring Team recommends that where possible States should backdate the measures to the date of the Committee's decision so that no targeted assets may escape freezing, as has happened with other sanctions regimes.
