وينبغي أن يبيّن قانون الإعسار:

This note describes some of the activities of international organizations active in the field of insolvency law.

(53) ينبغي أن يبيِّن قانون الإعسار أنه يجوز زيادة رهن الموجودات المرهونة، مع مراعاة الاشتراطات الواردة في التوصيات 65 و66 و67.

(53) The insolvency law should specify that encumbered assets may be further encumbered, subject to the requirements of recommendations 65, 66 and 67.

(ﻫ) فــي مجال الإعسار، قانون الأونسيترال النموذجي بشأن الإعسار عبر الحدود(16) ودليل الأونسيترال التشريعي بشأن قانون الإعسار؛(17)

(e) In the area of insolvency, the UNCITRAL Model Law on Cross-Border Insolvency and the UNCITRAL Legislative Guide on Insolvency Law;

ألف- ينبغي أن ينص قانون الإعسار على أنه في حالة إجراءات إعسار المانح، تكون لمموّل الاحتياز الحقوق والواجبات التي لحائز الحق الضماني.

The insolvency law should provide that, in the case of the insolvency proceedings of the grantor, the acquisition financier has the rights and duties of a holder of a security right.
