First, we have on several occasions informed the ICTR that since 1998 a moratorium has been in force on the death penalty, and that in any case the Government is willing to enter into an agreement with the Tribunal not to exercise the death penalty in any of the transferred cases.

The non governmental organization Together against the Death Penalty organized the First World Congress against the Death Penalty in Strasbourg, France, in June 2001 and the Second World Congress against the Death Penalty in Montreal, Canada, in October 2004.

The Committee recalls its jurisprudence that the automatic and mandatory imposition of the death penalty constitutes an arbitrary deprivation of life, in violation of article 6, paragraph 1, of the Covenant, in circumstances where the death penalty is imposed without any possibility of taking into account the defendant's personal circumstances or the circumstances of the particular offence.
