In implementation of the International Convention for the Suppression of the Financing of Terrorism (New York, 1999), Benin has integrated the suppression of the financing of terrorism in all its forms into its positive law.

Order No. 99 17 of 14 June 1999 now constitutes the positive law on the nationality of the Niger.

It was also pointed out that the concept of hierarchy in international law was an invention of doctrine rather than a positive law concept.

Its use of an empirical methodology that encompasses psychological experience contrasts to the purely positivistic approach typical of the natural sciences which exclude all methods not based solely on sensory observations.

It emerges from the situation described above that the women of the Niger continue to suffer from discrimination, particularly in the area of family rights, because a particular law has not been brought into line with, and indeed contravenes, positive law.

Burkina Faso stated that, in the positive law of Burkina Faso, the applicable Penal Code (Act 43 96 ADP of 13 November 1996) criminalized an organized criminal group.

Whether such suits would be dismissed would depend on the substantive law of the State Party concerned, which may not enforce resort to dispute settlement mechanisms under the Kyoto Protocol or established by the COP MOP.

This right has also been confirmed in statutory law, such as in the California Business and Professional Code 22, and in other case law precedents in circuit courts and in other reviewing courts in the US.

As does revolution within the internal constitutional order, the phenomenon of war presents itself as a method of abrogation that is abnormal, unpredictable, and extralegal in terms of positive law, with the qualification that while the principle of the nullifying effect of war is definite, there are nevertheless significant exceptions to this principle.

The presentation of these techniques jointly by the three experts was aimed, on the one hand, at highlighting the criminalization provisions contained in the aforementioned instruments and, on the other, at formulating based on analysis of relevant positive law in Burkina Faso the measures to be taken as needed to incorporate them in legislation.
