This guiding principle takes account of troop safety considerations and humanitarian issues.

That was the sense of draft guideline 3.1.9.

The view was also expressed in respect of both draft guidelines 3.1.5 and 3.1.13 that a reservation to a secondary provision that was linked to the raison d'être of the treaty could be equally risky. As to reservations to non derogable rules, while such rules often set out principles of jus cogens, the Special Rapporteur proposed draft guideline 3.1.10, which had been inspired by the practice of the human rights treaty bodies and the case law of the Inter American Court of Human Rights.
