In 2002, 40 per cent of LDC exports were subject to NTBs.

A status analogous to refugee status would not appear to be adequate. The people affected need more than a right to claim environmental asylum. They need a right to be granted it.

Every country must selfishly use a surge strategy to gain advantage.

The resort to this category does, however, generate certain problems.

In rural areas, straw is frequently used to build the walls of people's homes.

Recourse to the advisory jurisdiction of the Court has also been quite rare.

Asylum could be abused by international criminal groups seeking new avenues for their business, and consequently, host countries were developing stricter regimes for asylum seekers.

So why hasn t more adjustment taken place already?

The weapons inspectors were pulled out, and America opted for preemptive war.

It took hard military power to sever that tie.

But it is too late for divide and misrule strategies to work.

Thus, a new yardstick is needed to measure success.

Mengistu fled the country to asylum in Zimbabwe, where he still resides.

In order to address these problems, recourse has been made mainly to technical solutions.

Resort to smugglers has increased, as has the exposure to trafficking of women and children moving on their own.

Protection of asylum seekers

There is clearly a need for States to address asylum abuse and people smuggling, but, in this process, asylum must be preserved.

The development of the common asylum system would go hand in hand with a better reflection of refugee issues in the external policies of the European Union and the strengthening of partnerships with countries of first asylum.

(h) Changes have been introduced by the revised law on asylum which restrict or aggravate asylum seekers' access to legal counsel and the length and conditions of detention in preparatory or pre deportation detention.

Unfortunately, most of the alternatives call for the continued use of violence and terrorism.

Pending further studies of the means of achieving this objective, a first step would be to recommend to the Commission that it request all its thematic special procedures, within their respective mandates, to pay attention to situations of actual or potential armed conflict and to include the relevant IHL issues in their consideration and reports.
