The Panel finds that the claimant has failed to prove any direct loss and therefore recommends no award of compensation for D2 (personal injury) losses.

According to Iraq, the rules established by the Governing Council provide for the compensation of claims submitted by individuals for personal injury or mental pain and anguish.

According to section 1 of chapter 5 of the Finnish Damages and Tort Liability Act of 1974, damages shall constitute compensation for the personal injury and damage to property.

As the report did not identify the cause of the medical condition nor link the condition to the alleged beating and detention, the Panel recommends no award of compensation for D2 (personal injury) losses.

The Panel reviewed 117 claims with D2 (personal injury) or D3 (death) losses.

The claimant seeks compensation for these personal injuries in the amount of USD 100,000.

The person affected should request compensation for injury suffered as a result of the delay, in accordance with the procedure set out in the law.

The compensation sought also includes the costs of preparing educational material on the safe disposal of waste and personal hygiene.

Personal income compensation is determined as a minimum of 80 per cent of base compensation, and it cannot be lower than the minimum salary in the month for which it is determined.

An injury to one human being is an injury to all humanity.

Full reparation for the injury caused by the internationally wrongful act shall take the form of restitution, compensation and satisfaction, either singly or in combination, in accordance with the provisions of this chapter.

Reparation for injury

As a result of this clerical error, the Panel recommended no compensation for the claim, which included D1 (mental pain and anguish) and D4 (personal property) losses.

1. The State responsible for an internationally wrongful act is under an obligation to give satisfaction for the injury caused by that act insofar as it cannot be made good by restitution or compensation.

However, the only medical evidence provided by the claimant to prove his personal injury losses was a medical report dated 23 March 2003 indicating that he had eye surgery to remove cataracts.

In the view of the Panel, the fact that an injured national can bring an individual claim for a specific injury or damage does not affect the right or standing of a State to bring a national claim, so long as there is no duplication in compensation awarded for the same injury or damage.

31.9 Compensation is also provided to staff members or their dependants in the event of death, injury or illness attributable to the performance by the staff member of official duties on behalf of the United Nations.

Similarly, paragraph 34 of Governing Council decision 7 provides that compensation is available with respect to any direct loss, damage or injury to Governments as a direct result of Iraq's unlawful invasion and occupation of Kuwait.

The Panel notes that largest portion of the claim (USD 70,000,000) is for punitive damages, which are not compensable in principle pursuant to Security Council resolution 687 (1991), which limits compensation to direct loss, damage or injury.

In all cases, coverage is available only to those who are eligible to receive a periodic benefit from the United Nations Joint Staff Pension Fund or under the rules governing compensation for service incurred death, injury or illness.

31.8 The requirements under compensatory payments (see table 31.3) provide for compensation to members of commissions, committees and other similar United Nations bodies in the event of death, injury or illness attributable to service with the United Nations.
