There is no causation required between the misstatement and the liability for delay, loss or damage to the goods.

J. Question of liability

Such liability is incurred without prejudice to the criminal liability of individuals having committed the offences.

Since there was no consensus on liability or loss allocation in the event of harm arising out of acts not prohibited by international law, it was important that the draft principles should not be presented in a form which might be construed as a codification of customary international law.
