H. Privacy and property rights

Limitations on autonomy and privacy cannot be justified unless they meet the criteria for any restriction of a basic right, namely legitimate purpose, proportionality, necessity, and non discrimination.

The right to privacy and to judicial protection against arbitrary or unlawful interference with that right are guaranteed in article 17 of ICCPR and in article 11 and article 8 of the American Convention and the European Convention, respectively.
