Procedures for the consideration of communications received under the Optional Protocol

In networking, a communications protocol or network protocol is the specification of a set of rules for a particular type of communication.

The San Salvador Protocol to the American Convention on Human Rights allows individual communications in relation to two articles of the Protocol.

The seventh session of the Working Group on Communications under the Optional Protocol will be held from 9 to 13 January 2006.

The Committee is mandated under the Optional Protocol to the Convention to receive and consider communications from individuals or groups of individuals and to transmit its views with respect to such communications to the parties concerned.

In computing, a stateless protocol is a communications protocol that treats each request as an independent transaction that is unrelated to any previous request so that the communication consists of independent pairs of request and response .

A stateless protocol does not require the server to retain session information or status about each communications partner for the duration of multiple requests.

4.2 The State party notes that the Optional Protocol does not include a special time limit for the presentation of communications to the Committee.

The Secretary General shall maintain a permanent register of all communications submitted for consideration by the Committee under article 2 of the Optional Protocol.

The working group may wish to consider which approach would be best suited in relation to an optional protocol taking the form of a communications procedure.

Consequently the communication must be considered inadmissible, in accordance with article 3 of the Optional Protocol, as an abuse of the right of submission of communications.

Mr. Flinterman welcomed Benin's ratification of the Optional Protocol to the Convention but recalled that communications could be referred to the Committee only when all local remedies had been exhausted.

The Committee therefore concludes that the submission of the communication does not constitute an abuse of the right of submission of communications in the sense of article 3 of the Optional Protocol.

Accordingly, the Committee concludes that the authors may not consider themselves victims within the meaning of article 1 of the Optional Protocol in respect of the aforementioned complaint and finds this part of the communications submitted by the authors inadmissible in accordance with article 1 of the Optional Protocol.

This report shall be prepared each time that the review process under Article 8 of the Kyoto Protocol relating to national communications and supplementary information from Parties included in Annex I is completed.

In 2004, it ratified the Optional Protocol to the Convention on the Elimination of All Forms of Discrimination against Women, thus recognizing the competence of the Committee to consider communications submitted by individuals.

It appears to allege that the communication should be considered inadmissible as constituting an abuse of the right to submit communications under article 3 of the Optional Protocol in view of the time elapsed.
