ولا يزال يوجد خطر كبير لتعرض صاحب الشكوى للتعذيب أو ما يشابهه من سوء المعاملة.	There remains a considerable risk that the complainant will be subjected to torture or treatment approximating it.
وترى الدولة الطرف أن تغير السلطة السياسية قلص إلى حد كبير خطر تعرض صاحب الشكوى للاحتجاز والتعذيب.	The State party considers that the transfer of political power has therefore substantially reduced the complainant's risk of being subjected to detention and torture.
9 3 وفيما يتعلق بما يمثله صاحب الشكوى من خطر على السلامة العامة، تؤكد المحامية أن صاحب الشكوى قد ارتكب فعلا خطيرا ، ولكنه لا يشكل بذلك خطرا شديدا على عامة الجمهور.	9.3 Concerning the danger represented by the complainant and the risk to public safety, counsel maintains that he committed a serious act, but did not thereby pose a serious risk to the general public.
غير أن الهدف من دراسة اللجنة هو إثبات ما إذا كان صاحب الشكوى سيواجه شخصيا خطر التعرض للتعذيب إذا أعيد إلى بلده.	However, the aim of the Committee's examination is to establish whether the complainant would be currently at risk of torture if returned.

Furthermore, in respect of the State party's contention that the complainant's risk of being maltreated by political opponents falls outside the scope of article 3, it is submitted that the complainant does not claim a risk of maltreatment by political opponents, but by the Bangladeshi police.

6 4 أما عن ادعاء صاحب البلاغ أنه كان ينبغي بدلا من حبسه حبسا احتياطيا لمدة 40 يوما ، الإفراج عنه في انتظار محاكمته لانتفاء خطر هروبه، تلاحظ اللجنة أن التهمة لم توجه إلى صاحب البلاغ إلا في 25 تشرين الثاني نوفمبر 1999، حين أ طلق سراحه.	6.4 As to the author's claim that, rather than being detained in custody for 40 days, he should have been released pending trial, in the absence of a risk of flight, the Committee notes that the author was not charged until 25 November 1999, when he was also released from custody.
وفي هذه الظروف، تخلص الدولة الطرف إلى أن من غير المحتمل أن تؤدي إعادة صاحب الشكوى إلى بلده الأصلي إلى حدوث خطر حقيقي بالمعنى المقصود في المادة 3 من الاتفاقية.	In the circumstances, the State party concluded that sending the complainant back to his country of origin was not likely to give rise to a substantial danger within the meaning of article 3 of the Convention.
8 8 وترى الدولة الطرف أنه يجب القول بأن حالة صاحب الشكوى كانت في اليوم الذي ن فذ فيه الأمر بالترحيل قد جرى استعراضها بصورة عادلة دون أن ي بين صاحب الشكوى أنه سيكون في خطر شديد وحالي بالتعرض للتعذيب أو المعاملة اللاإنسانية في حال إعادته إلى الجزائر.	8.8 In the State party's view, by the day the deportation order was enforced, the complainant's situation must be said to have been fairly reviewed without his showing that he would be in serious and present danger of torture or inhuman treatment if returned to Algeria.
