(k) Equipment means tangibles (other than negotiable instruments, negotiable documents and inventory), used by a person in the operation of its business.

(a) Qualifies as a protected holder under the law governing negotiable instruments or

(j) Inventory means a stock of tangibles (other than negotiable instruments and negotiable documents) held for sale or lease in the ordinary course of business and also raw and semi processed materials (work in process).

Negotiable documents

(g) A letter of credit or independent guarantee.

In most cases, national legislation establishing requirements to declare the cross border transport of cash was also applicable to negotiable bearer instruments.

However, comments had been received from Member States to the effect that the provision was unwarranted because the draft convention did not cover negotiable instruments.

Holders of promissory notes and negotiable documents

Mr. Boulet (Belgium), endorsing the comment made by the previous speaker, said that draft article 2, paragraph 2, excluded only negotiable instruments and documents of title from the scope of application of the draft convention.

The Americas was the only region where a majority of the States (65 per cent) reported that their national legislation required the declaration of the cross border transport of negotiable bearer instruments exceeding a specified amount.

With the tradable sector neutralized and the non tradable sectors maxed out, the economy lacks sufficiently powerful growth engines.

Asked whether their national legislation required the declaration of negotiable bearer instruments being transported across borders, 40 per cent of States indicated such a requirement (compared with 45 per cent for the second reporting period and 31 in the first).

The law should provide that a security right in a negotiable document and the goods represented thereby is subject to the rights under the law governing negotiable documents of a person to whom the negotiable document has been duly negotiated.

Competitive currencies promote and protect modern tradable industries that employ a substantial share of the labor force.

Likewise, economies have not recovered lost competitiveness, so employment, especially in the traded goods sector, is lower than it should be.

This pattern is particularly pronounced in the non tradable sectors (which account for two thirds of the economy), where the discipline of foreign competition is absent by definition.

Mr. Mazzoni (Italy), referring to paragraph 2 of draft article 2, said he understood that the intention had been to exclude instruments that were designed to circulate .
