Having concluded its consideration of complaint No. 218 2002, submitted to the Committee against Torture by Mr. L.J.R.C.

The Panel considers that the totality of the evidence presented supports the earlier award of compensation and recommends that no adjustment be made to this award.

The Panel finds that the evidence provided to support this claim unit is not sufficient to demonstrate the circumstances of the loss claimed.

6.10 By her submission of 30 June 2004, the author informs the Committee that the criminal proceedings against L.

The Panel, therefore, concludes that the evidence presented does not demonstrate that Jordan's population was deprived of water as a result of the presence of the refugees.

In the view of Iraq, the claim is unjustified because of the insufficient evidence provided and the absence of proof that any loss was incurred by Kuwait.

He states that, during his trial, only abstract and indirect evidence was produced against him, some of which was extracted from other detainees through threats and beatings.

Where the Panel is of the view that insufficient evidence was given to support either the fact of loss or the value of loss, the Panel has adjusted the claim to account for this risk of overstatement.

She contends that the evidence submitted to the Committee clearly shows that the execution of the order would constitute such treatment, at least in the case of her daughter.

The Panel finds that the medical evidence submitted was insufficient to prove that the claimant's epilepsy was caused by Iraq's invasion and occupation of Kuwait.

After considering all of the evidence provided, the Panel determines that the claimant has failed to prove the alleged loss and recommends no award of compensation.

Should the Committee consider the case sufficiently substantiated, the State party submits that the author has failed to demonstrate a violation of any of the provisions of the Covenant.

In November 1998, the Supreme Court dismissed the author's appeal, stating that it was not the task of the Court to weigh the evidence in the case.

In these sorts of examples an increase in the number of Identifiers and Corroborators can be postulated to increase the value (in confidence building terms) of the overall evidence being presented, with Identifiers perhaps being the strongest contributors to this.

5.1 By its submission of 20 April 2004, the State party gave an explanation of the civil proceedings to which reference is made by the author, stating that in May 2000 L.

After reviewing the evidence provided by both claimants, the merged E4 Panel made a determination about which claimant had sustained the loss.

It submits that the claim under article 3 should be declared inadmissible, since it lacks the minimum of substantiation to make it compatible with provisions of the Convention.

6.11 By her submission of 19 October 2004, the author informs the Committee that the Pest Central District Court (Pesti Központi Kerületi Bíróság) convicted L.

The Committee also notes, from the copy of the judgement in first instance submitted by the authors, that the evidence against them did not consist only of expert reports.

Moreover, the evidence presented does not enable the Panel to draw any conclusions about the nature and extent of deterioration that could have been the result of contact with the particulate deposition.

Both courts thoroughly addressed the author's allegation that circumstantial evidence was insufficient to convict him, and disagreed with his account, developing extensive arguments to conclude that the evidence, though circumstantial, was sufficient to warrant the author's conviction.

5.1 As to the admissibility of the complaint, the complainant maintains that the evidence submitted fulfils the minimum standard of substantiation that it is required in order to make the complaint compatible with article 22 of the Convention.

The Committee has also noted the statement, in the judgement of the Regional Trial Court, which confirms that on the whole, the evidence for the prosecution has overcome the accused's constitutional presumption of innocence.
