The Panel considers that the totality of the evidence presented supports the earlier award of compensation and recommends that no adjustment be made to this award.

The Panel finds that the evidence provided to support this claim unit is not sufficient to demonstrate the circumstances of the loss claimed.

The Panel, therefore, concludes that the evidence presented does not demonstrate that Jordan's population was deprived of water as a result of the presence of the refugees.

In the view of Iraq, the claim is unjustified because of the insufficient evidence provided and the absence of proof that any loss was incurred by Kuwait.

He states that, during his trial, only abstract and indirect evidence was produced against him, some of which was extracted from other detainees through threats and beatings.

Where the Panel is of the view that insufficient evidence was given to support either the fact of loss or the value of loss, the Panel has adjusted the claim to account for this risk of overstatement.

She contends that the evidence submitted to the Committee clearly shows that the execution of the order would constitute such treatment, at least in the case of her daughter.

The Panel finds that the medical evidence submitted was insufficient to prove that the claimant's epilepsy was caused by Iraq's invasion and occupation of Kuwait.

After considering all of the evidence provided, the Panel determines that the claimant has failed to prove the alleged loss and recommends no award of compensation.

Should the Committee consider the case sufficiently substantiated, the State party submits that the author has failed to demonstrate a violation of any of the provisions of the Covenant.

Both courts thoroughly addressed the author's allegation that circumstantial evidence was insufficient to convict him, and disagreed with his account, developing extensive arguments to conclude that the evidence, though circumstantial, was sufficient to warrant the author's conviction.

5.1 As to the admissibility of the complaint, the complainant maintains that the evidence submitted fulfils the minimum standard of substantiation that it is required in order to make the complaint compatible with article 22 of the Convention.

The Committee has also noted the statement, in the judgement of the Regional Trial Court, which confirms that on the whole, the evidence for the prosecution has overcome the accused's constitutional presumption of innocence.

For the reasons set out and in the light of the information supplied, I conclude that the author has not substantiated any of her allegations that she was victim of a violation of article 18 of the Covenant.

While the Panel noted that the claimant had not signed the submission that included the fabricated documents, the Panel finds that the claimant is responsible for the evidence submitted to the Commission by his authorized representative.

2.10 The Aliens Appeals Board denied the new applications on the basis that the evidence presented, as well as an assessment of the personal situation of the complainant as a whole, were insufficient to justify the issuance of residence permits.

(e) Collection of evidence

In view of these irregularities, and in the absence of an acceptable explanation from the claimant for the audit date on the 1990 accounts, the Panel considers that there is a fundamental risk that the evidence provided to support this claim is unreliable.

Further, the Panel finds that to rely on the revised category D claim and its supporting evidence would be tantamount to allowing the individual claimant to file a new claim after the deadline for filing of claims.

The evidence against the author consisted in testimonies about the threats and experts' affidavits on the type of explosives used by the accused and the extent of the damage caused to the victim's premises.

Whether or not any environmental damage or loss for which compensation is claimed was a direct result of Iraq's invasion and occupation of Kuwait will depend on the evidence presented in relation to each particular loss or damage.

Whether, and if so to what extent, any such claim by a government will succeed depends on the nature of the claim and the evidence produced to support it.

Admissibility of evidence in other proceedings

The Panel noted that the medical evidence provided in support of the claimant's personal injuries indicates that the injuries, although sustained during the occupation period, were work related and not suffered as a direct result of Iraq's invasion and occupation of Kuwait.
