فماذا لو لم يقم الناقل بتسليم البضاعة إلى الشخص صاحب الحق فيها؟ إن الفصل 6 (الفصل 5 سابقا) ينطبق فقط على هلاك البضاعة أو تلفها أو تأخّرها، ولا ينطبق، مثلا، على الخطأ في التسليم.
