2- المحكمة التي رفعت أمامها الدعوى توجد في دولة متعاقدة

The court seized is located in a Contracting State.

1 - يجوز لأي دولة متعاقدة أن تعلن، وفقا للمادة 21، أنها لن تطبق هذه الاتفاقية إلا:

1. Any Contracting State may declare, in accordance with article 21, that it will apply this Convention only:

"(أ) كان مكان التسلّم [التعاقدي] [أو ميناء التحميل [التعاقدي]] واقعا في دولة متعاقدة، أو

“(a) the [contractual] place of receipt [or [contractual] port of loading] is located in a Contracting State, or

"(ب) كان مكان التسليم [التعاقدي] [أو ميناء التفريغ [التعاقدي]] واقعا في دولة متعاقدة، أو

“(b) the [contractual] place of delivery [or [contractual] port of discharge] is located in a Contracting State, or

22- وتشترط جميع اتفاقيات الأونسيترال أن يكون طرف واحد على الأقل منتميا إلى دولة متعاقدة.

All UNCITRAL conventions require that at least one of the parties should belong to a contracting State.

وعندئذ تنطبق على العقود الخاضعة لقانون دولة متعاقدة عندما يتفق الطرفان التجاريان على ذلك.

It would then apply to contracts that were subject to the law of a Contracting State when commercial parties so agreed.

1 - يجوز لكل دولة متعاقدة أن تنسحب من هذه الاتفاقية في أي وقت بإشعار كتابي موجَّه إلى الوديع.

1. A Contracting State may denounce this Convention at any time by written notification addressed to the depositary.

(أ) اتخاذ تدابير إدارية مغايرة للقوانين والممارسات الإدارية المرعية في تلك الدولة أو في دولة متعاقدة أخرى؛

(a) To carry out administrative measures at variance with the laws and administrative practices of that or the other Contracting State;

"(ج) [كان مكان التسليم الفعلي واحدا من أماكن التسليم الاختيارية [بمقتضى العقد] وواقعا في دولة متعاقدة، أو]

“(c) [the actual place of delivery is one of the optional places of delivery [under the contract] and is located in a Contracting State, or]

لن تطبق هذه الدولة الاتفاقية الا على الاعتراف بقرارات التحكيم الصادرة في أراضي دولة متعاقدة أخرى وعلى انفاذ تلك القرارات.

This State will apply the Convention only to recognition and enforcement of awards made in the territory of another contracting State.

(7) "تنطبق هذه الاتفاقية: (أ) على إحالات المستحقات الدولية [] إذا كان مقر المحيل يقع، وقت إبرام عقد الإحالة، في دولة متعاقدة. "

“This Convention applies to (a) assignments of international receivables […] if, at the time of conclusion of the contract of assignment, the assignor is located in a Contracting State.”

3 - لا تمس هذه الاتفاقية حقوق المدين والتزاماته، ما لم يكن مقر المدين واقعا، وقت إبرام العقد الأصلي، في دولة متعاقدة أو يكن القانون الذي يحكم العقد الأصلي قانون دولة متعاقدة.

2. This Convention applies to subsequent assignments that satisfy the criteria set forth in paragraph 1 (a) of this article, even if it did not apply to any prior assignment of the same receivable.
