The Committee notes with appreciation the adoption of the Law on the People's Rights Defenders (Ombudsmen), the election of the first Ombudsman in November 2002 and the establishment of a section for children's rights issues within the Office of the Ombudsman.

There was no duplication of mandate, since the Office of the Ombudsman examined the performance of government officials only.

As with the Ombudsman, it is proposed that the head of the ethics office be appointed at the level of Assistant Secretary General for a fixed, non renewable five year term.

Based upon the above, a conclusion can be made that the institution of Ombudsman in Bosnia and Herzegovina, in accordance with its responsibilities and mandate set forth by the Law on the Ombudsman for Human Rights, takes measures, implements activities and gives recommendations in order to achieve at the complete realization of the rights recognized by the International Covenant on Economic, Social and Cultural Rights in Bosnia and Herzegovina.

All interactions with the Ombudsman are voluntary.

While welcoming the adoption of the Law on the People's Rights Defenders and the fact that the Office of the Ombudsman has established a specific department dealing with children's rights, the Committee is concerned that the Law does not specifically empower the Ombudsman to receive and address individual complaints from children.

The High Commissioner urges the Ombudsman's Office to assume the task of overseeing the promotion, exercise and dissemination of human rights throughout the country.

The Commission also notes the work of the Office of the Ombudsman and other State institutions in the defence of human rights.

In connection with the latter, the Committee notes that the current ombudsperson system is proposed to be strengthened with participation by UNICEF in the joint office of the Ombudsperson of UNDP, UNFPA and UNOPS, at the request of UNICEF.

Moreover, it periodically submitted reports on problems encountered in the protection of children and had recently established the office of a Children's Ombudsman.

The Commission also notes the work undertaken by the Office of the Ombudsman, together with other institutions, to set up a mechanism to investigate cases of disappearance.

Under the Ombudsman Act 1983 (Vic), the Ombudsman should make independent inquiries into administrative action taken by relevant public bodies.

Human rights violations against Government employees can be taken to the Office of the Ombudsman if their rights are infringed but it does not have the power to prosecute.

OHCHR is actively engaged with the Human Rights Office in Angola in working with the Government towards the development of the Provedor de Justiça and the drafting of its enabling legislation in accordance with the Paris Principles.

The Committee welcomes the assurance provided by MSAR that the Office of the Ombudsman has the mandate to receive complaints on violations of economic, social and cultural rights.

If the concern raised by a staff member related to an interpersonal problem within a particular office, the ethics office would advise the staff member concerned of the existence of the Office of the Ombudsman, as well as the other informal mechanisms of conflict resolution in the Organization.

(l) About the lack of regular and unannounced visits to police stations by the Office of the Ombudsman

In its resolution 59 283 (para. 20), the Assembly requested that the Office of the Ombudsman submit proposals for improving access to the Office for staff serving in different locations.

The Committee welcomes the establishment of the Office of the Ombudsperson for Children in 2003 and the presence of the Ombudsperson at the dialogue, but the Committee is concerned at the need for ongoing and sufficient political, human and financial support for the functioning of this office.
