This self restraint seems logical in light of UNCITRAL's mandate to further the progressive harmonization and unification of the law of international trade .

The substantive law issues relating to security and other rights in securities held with an intermediary are dealt with in a draft Convention being prepared by the International Institute for the Unification of Private Law (Unidroit).

Although the language of the Model Law had not given rise to difficulties, it would be helpful to clarify that draft paragraph 2 was intended to refer to conflict of law rules and not to law in general or law merchant.

Concerned that activities undertaken by other bodies in the field of international trade law without adequate coordination with the Commission might lead to undesirable duplication of efforts and would not be in keeping with the aim of promoting efficiency, consistency and coherence in the unification and harmonization of international trade law,

Work on international trade law now incorporates enhanced cooperation with other organizations formulating rules in international trade, under the guidance of UNCITRAL, and a work programme and timetable for expanded technical assistance activities.
