The lack of strong rules on hand emplaced mines would significantly reduce the effectiveness of a new MOTAPM instrument.

There are a number of regulations applicable to MOTAPM which are common to both instruments.

China believes that in the pre war period, minefields should be monitored and guarded effectively, but need no marking or fencing in the post war period, however, minefields should be marked and fenced immediately.

Taking into account the views of other parties on this issue, China is ready to demonstrate flexibility by making some amendment to the provisions on the first category of sensitive fuzes in the Coordinator's Paper, i.e., tilt rods do not appear to be a recommended method of activation, if it cannot be designed in such a way that an individual cannot, within reason, initiate the mine .

At the Nairobi Summit on a Mine Free World, a child addressed the States party to the Convention on the Prohibition of the Use, Stickpiling, Production and Transfer of Anti Personnel Mines and on their Destruction, contributing to renewed commitment by the international community eliminate the threat of landmines.

The ICRC supports the efforts to reduce the potential problems caused by mines with sensitive fuzes in a future MOTAPM instrument.

The permitted purpose for which mines were used, the activity or project in which these mines were used, progress made or objectives realized in the use of these mines, the types and quantities of mines used and any other relevant information (e.g., the location of the use of the mines).

The nub of the MOTAPM problem lies in the way in which they are used, and not in their design.

It is a fact that the humanitarian concerns caused by MOTAPM mainly arise from two kinds of irresponsible use of MOTAPM one is the use of MOTAPM by non State actors the other is the absence of record and monitoring of the minefields.

It is therefore necessary to strictly restrict the use of MOTAPM in the above mentioned aspects for the effective solution to the humanitarian concerns caused by MOTAPM.

The ICRC proposes that a future instrument incorporate all text contained in Article 3 and Article 10 of the Amended Protocol as they apply to MOTAPM, as well as to anti personnel mines.
