(d) Engage in serious efforts to reform the Family Code and

Spouses have equal rights with respect to ownership, use and disposition of both of personal property (article 36 of the Family Code) and common property (article 34 of the Family Code).

There was no Family Code to decide such matters, but the Civil Code included laws covering children and adolescents, and in the absence of family courts the civil courts judges dealt with such issues.

We have also adopted a modern family code that ensures gender equality, guarantees children's rights, and protects family cohesion and unity.

(a) The provisions of the Family Code are based on the principle of equal rights for men and women in family relations.

The Civil Code, particularly the Family Law that safeguards the ideal of a society based on patrilineal family unity, regulates the marriage.

Under the Code, the Government had established family courts and instituted training programmes for officials.

There has been progress in reforming family law, particularly through the draft Code of Persons and the Family and the draft revisions to the Civil Code, which the government is now examining for early submission to the National Assembly.

Under art. 63 of the Family Code, parents have rights and responsibilities in raising their children.

The Family Code has established the age at which one can marry as 17 (article 13).

It is therefore necessary to align civil legislation with constitutional provisions by adopting a Family Code.

Moreover, in accordance with the Code, the husband was solely responsible for choosing the family home.

In spite of relatively solid legislation concerning the criminal code and family relations, practice is, however, different.

Under article 1 of the Family Code, only marriages registered with the civil registry office are recognized.

(b) The amendments to the Family Act, the Criminal Code and the Criminal Procedure Act in 2003

It also welcomes the information that a new Family Code is being prepared in a consultative process.

The crime of violence against women was not regulated in the Code of Persons and the Family but rather in the Penal Code, which prohibited it. The revised Penal Code would deal with domestic violence as well.

Under art. 63 of the Family Code, parents bear responsibility for the upbringing and development of their children.

There is at present no specific section in the Penal Code to deal with abuses in the family .

In addition, the Family Code also stipulates the equality of the rights of spouses to property if one of the spouses keeps house and looks after the children or, for other legitimate reasons, does not earn a wage (article 34 of the Family Code).

Legal reforms or the adoption of a family legal code can provide legal protection to families and their children.

The authorities decided in 1975 to begin drafting a family code to address this legal limbo and consequent discrimination.

Under art. 64 of the Family Code, protection of the rights and interests of minor children rests with the parents.

Until 2004, family violence was not sanctioned as a separate crime in the Criminal Code of the Republic of Macedonia.

It can be argued that the penal code affords protection in all cases and in all settings, including the family.

It is particularly important for the family law code to be revised before any project about formalizing land titles is undertaken.

There is at present no specific section in the Penal Code to deal with abuses in the family or domestic violence.

They enjoy equal rights and bear equal responsibilities as parents even when the marriage is dissolved (article 66 of the Family Code).

Article 319 of the draft code provides that marriage does not authorize the wife to take the family name of the husband.

Subsequently, legislation had been introduced to liberalize family planning laws, increase protection of women and children's health, and amend the Nationality Code.

However, after eight years of preparation, the new Code on the Person and the Family had finally entered into force on 1 December 2004.

The greater seriousness of offences against a family member is due to aggravating circumstances laid down in the general part of the Penal Code.

The need to adopt a family code should be emphasized in the light of the true position that women hold in a law based State.

Nevertheless, the Civil Code still contains provisions which name the man as head of household and representative of the family, or, in his absence, the woman.

Awareness raising sessions were being organized at the departmental and communal levels to promulgate the Code on the Person and the Family, especially among rural women.
