It argues that the petitioner has failed to exhaust domestic remedies available in criminal proceedings in three respects.

8.5 On the issue of exhaustion of domestic remedies, the State party submits that the claims under articles 17 and 18 were not raised in the domestic proceedings, and thus domestic remedies have not been exhausted.

8.4 The Committee, nevertheless, wishes to make some observations as to the State party's comment in its submission of 20 April 2004 that some domestic proceedings are still pending.

On 22 January 2002, the Court dismissed the authors' claims in respect of the proceedings concerning the IG Farben and Dresdner Bank shares for non exhaustion of domestic remedies.

The fact, moreover, that other proceedings are challenging the marked predominance requirement does not change the fact that the present authors have exhausted available domestic remedies for their convictions.

He did not bring these proceedings before his original case was heard, and thus should not be able on principles of failure to exhaust domestic remedies to argue that the court's original decisions were wrong.
