Stressing the need for better cooperation in the recovery of assets derived from corruption, many speakers welcomed the achievement of the United Nations Convention against Corruption to include for the first time in an international legal instrument a comprehensive chapter on asset recovery.

Several speakers acknowledged the innovative nature of the Convention, especially because of the comprehensive chapter on preventive measures and the enshrinement of asset recovery as a fundamental principle.

They underlined that the United Nations Convention against Corruption was the only international instrument dealing with the issue of asset recovery and return in the context of corruption.

Venezuela had participated actively in the drafting of the United Nations Convention against Corruption, particularly on the issues of asset recovery and the capture and prosecution of criminals.

The complexity of its provisions, especially in relation to asset recovery, was also highlighted, together with the need for technical assistance to be made available, upon request, to developing countries.

The Convention reflects a multidisciplinary approach and contains comprehensive provisions that cover prevention, criminalization, international cooperation, technical cooperation and, for the first time in an international legal instrument, asset recovery.

The recent recovery of asset prices from their March lows is in part justified by fundamentals, as the risks of global financial meltdown and depression have fallen and confidence has improved.

Second, it increases global asset demand, generating asset price inflation.

The banking system is not primarily suffering from a temporary breakdown of the inter bank market and a transitory decline in asset values that could be overcome simply by waiting for recovery.

The asset that is purchased need not be a physical asset.

Indeed, public sector asset management could be outsourced, with private asset managers competing for the job. This would accelerate the development of the asset management sector, with far reaching benefits for savers and investors.
