Nov. 2003 Assumed office as ad litem Judge at the International Criminal Tribunal for the Former Yugoslavia

Statements were made by Judge Erik Møse, President of the International Criminal Tribunal for Rwanda and Judge Theodor Meron, President of the International Tribunal for the Former Yugoslavia.

As an act involving the security of the State, the case was referred to the Judicial Council in implementation of the relevant national legislation and on 21 February Judge Michel Abu Araj, Chief Judge of the Criminal Court, was appointed as the investigating Judge, replacing Judge Mezhar.

This, to the judge, showed that the prosecution had implied there were no grounds for criminal proceedings against Mubarak.

We wish to thank the President of the International Criminal Court (ICC), Judge Philippe Kirsch, for his earlier presentation.

I especially congratulate Judge Fausto Pocar on his appointment as President of the International Criminal Tribunal for the former Yugoslavia.

With the creation of the new special courts, with civil and criminal jurisdiction, the judge will be endowed with greater competence to judge these cases, thereby facilitating women's access to justice and the resolution of conflicts.

Nature of work Based on my previous records in handling criminal cases while a magistrate, I was posted to Kwali High Court as pioneer judge to the area because of concentration of criminal matters.

Women could be forced to undergo the tests only as part of a criminal investigation, on the instructions of a judge or prosecutor.

It will provide the judge with the choice of the most suitable measure to each case, in both the civil and criminal areas.

C. Judge (ad litem) in the United Nations International Criminal Tribunal for the Former Yugoslavia (ICTY), The Hague December 2003 and at present (elected by the General Assembly in June 2001).

The author states that the high court's decision led her to lodge a criminal complaint against the lower court judge, in view of the corporate spirit which prevailed among the judges.

In these systems, the State often has to present to a judge or enforcement authority sufficient evidence of a specific criminal offence to freeze (or maintain an emergency freeze) of assets.
