Illicit brokering of small arms and light weapons

During the consultations, general agreement emerged for States to adopt laws and regulations to control brokering and to develop regional and global agreements on the brokering of small arms and light weapons.

Developing a tool to confront illicit brokering is the next step forward.

However, the issues of extraterritorial jurisdiction and the definition of the scope of brokering activities remain controversial.

I. The reception, brokerage, and investment of third parties' funds in Brazilian or foreign currency

The custody, issuance, distribution, clearing, negotiation, brokerage or management of securities

The amendments apply to inclusion of the terorism aspect, as well as expanding the scope of brokering controls to include certain sensitive dual use items.

According to the Act, the export, transit or brokerage of defence materiel is subject to specific authorization (export and brokerage licence).

It was suggested that the existing regional and subregional agreements could provide a basis for discussions on a global instrument regarding arms brokering.

For example, the Firearms Bill contains a new list of prohibited firearms and it also makes provision for the prohibition of brokering activities.

Member States also suggested that the group address the link between illicit brokering and the inadequacy of end user certificates, as well as marking and tracing.

The issue of definition continues to be debated, however, and issues raised during the United Nations consultative process focused on accurately defining the term brokering and whether related activities, such as financing, transport and export controls, should also be included in any core definition.

Broad based consultations on further steps to enhance international cooperation in preventing, combating and eradicating illicit brokering in small arms and light weapons

We agree to develop a legally binding international instrument to regulate the marking and tracing of small arms and light weapons, as well as one to combat illicit brokering.

Article 1 of the ordinance specifies that the supply, sale, transit as well as brokering of items of military equipment of any kind intended for the Sudan are prohibited.

Our next step should be to consider how to improve international cooperation in preventing, combating and eradicating illicit brokering in small arms and light weapons.

(2) Trading or brokering in Schedule 2 chemicals coming from or intended for a State not a party to the Paris Convention

In preparation for the broad based consultations, the Department organized two workshops on the illicit brokering in small arms and light weapons, with financial support from the Governments of the Netherlands and Norway.

Suggestions were made that the group should, among other things, address funding, banking and shipping activities, licensing systems, the definition of illicit brokering, and the issue of extraterritorial jurisdiction.

As brokering is an essentially intangible activity that encompasses various forms and types of operation, it is very difficult to define comprehensively.

Its adoption also augurs well for maintaining the momentum of active dialogue among Member States on tackling the issue of illicit brokering in small arms and light weapons.

Some speakers supported the establishment of a group of governmental experts to consider further steps to enhance international cooperation in preventing, combating and eradicating illicit brokering.

11. Decides to consider at its fifty seventh session further steps to enhance international cooperation in preventing, combating and eradicating illicit brokering in small arms and light weapons

Small capitalization equity investments require frequent visits to companies for purposes of research as less information is provided by investment advisers and brokerage houses on these types of investments.

(c) Develop legally binding international instruments to regulate the marking, tracing and illicit brokering of small arms and light weapons and ensure the effective monitoring and enforcement of United Nations arms embargoes

My delegation is therefore pleased that that resolution requests the Secretary General to hold broad based consultations on the issue of brokering, with a view to establishing a group of governmental experts on this issue not later than 2007.

I urge Member States to agree on an instrument to regulate marking and tracing no later than next year's Review Conference on the Programme of Action, and to expedite negotiations on an instrument on illicit brokering.

Before membership in EU, Lithuania passed a new Law on the Control of Strategic Goods on 1 May 2004, which now includes provisions on brokering, transfer of intangible items, and the like.

The supply, sale and brokering of technical advice and training or assistance related to the supply, production, maintenance and use of the items referred to in paragraph 1 are prohibited.

Beyond investment banks and brokerage houses, modern finance has a public and governmental dimension, which clearly needs reinventing in the wake of the recent financial crisis.

The trade, import, export, acquisition, brokering or transport of weapons of mass destruction whether nuclear, chemical or biological weapons or their components, through the territory of the Republic of Poland are explicitly prohibited under Polish law.

Article L. 2342 71 Unauthorized trading or brokering in Schedule 3 chemicals intended for a State not a party to the Paris Convention is punishable by a year's imprisonment and a fine of 15,000 euros.

I am particularly pleased to note the progress being made on the issue of illicit brokering in small arms and light weapons, which has been an area of concern, particularly in connection with activities of terrorist groups.

The broad based consultations on illicit brokering held by the Secretariat have highlighted once again the complex nature of the small arms challenge and the need to continuously develop the capacity of affected States to address its multiple facets.

The European Union underlines the importance of establishing a group of governmental experts soon after the 2006 Programme of Action Review Conference, in order to consider further steps to enhance international cooperation in preventing, combating and eradicating illicit brokering in small arms and light weapons.

The Team assessed the 140 reports submitted by States pursuant to resolution 1455 (2003) and concluded that most States have measures to regulate the trafficking, acquisition, storage and trade in arms, although not all have provisions to cover arms brokering.

7. Also encourages States to include in their national reports, on a voluntary basis, information on their efforts to prevent, combat and eradicate illicit brokering in small arms and light weapons, as well as on their actions aimed at enhancing international cooperation for this purpose

(2) The import, export or transit of, or trade or brokering in, Schedule 1 chemicals for medical, pharmaceutical, research or protection purposes which come from or are intended for a State not a party to the Paris Convention.

But the policy failures fueling this stock market fiasco go back further, to the massive government fueled surge in credit since the global financial crisis. Without that, brokerages would not have had all of that liquidity to lend for margin trading.

(2) The unauthorized import, export or transit of, or trade or brokering in, Schedule 1 chemicals for medical, pharmaceutical, research or protection purposes where such chemicals were obtained from or are intended for a State Party to the Paris Convention.

6. Recalls that the group of governmental experts, established to consider further steps to enhance international cooperation in preventing, combating and eradicating illicit brokering in small arms and light weapons is to submit a report on the outcome of its study to the General Assembly at its sixty second session
