If the requirements for the entry into force of the amendment have not been met by the date fixed by the Council in accordance with paragraph 2 of this article, the amendment shall be considered withdrawn.

The General Legal Division revised the draft amendment, incorporating in it suggested criteria for the application of the provision the amendment has now been adopted as section 9.8 of the Procurement Manual.

The draft is to be submitted to the National Assembly.

Before proceeding further, I would like to inform members that the sponsor of the amendment contained in document A 60 L.35 has withdrawn the amendment.

Adopting an amendment would be a lengthy process because it would take time for Parties to negotiate and reach agreement, and for the required number of ratifications to be obtained to enable the amendment to enter into force.

And in some cases, our desire to be original is actually a form of editing.

After the depositary informs the Council that the requirements for entry into force of the amendment have been met, and notwithstanding the provisions of paragraph 2 of this article relating to the date fixed by the Council, a member may still notify the depositary of its acceptance of the amendment, provided that such notification is made before the entry into force of the amendment.
