It was stated that it was not possible to understand the rationale for protecting third party holders of non negotiable instruments.

Modern services are becoming increasingly tradable, providing new export opportunities.

This is because most services are not tradable and they need to be produced when and where they are consumed (UNCTAD 2004b).

It was also stated that in some legal systems reliance was attached to documents other than bills of lading, as well as to documents held by the shipper, and that practice also involved the circulation of non negotiable instruments.

Negotiable documents

The law should provide that the rights of a person who by other law takes rights in a promissory note or negotiable document free of claims to it holder in due course of a promissory note or negotiable document takes such asset free of a security right that is effective against third parties.

The same question arises with respect to receivables, negotiable instruments, negotiable documents and bank accounts.

For starters, technology is making even many service jobs tradable, enabling them to be offshored to Asia and other emerging markets. And, eventually, technology will replace manufacturing and service jobs in emerging markets as well.

Investment pooling has permitted Treasury to limit very short term deposits to approximately 20 to 25 per cent of investments, allowing the remainder to be held in marketable fixed income securities.

Two things make services different from manufacturing. First, while some segments of services are tradable and are becoming more important in global commerce, these typically are highly skill intensive sectors that employ comparatively few ordinary workers.

In order to avoid any inconsistency in this respect, the Belgian delegation thus considers it preferable to deal simultaneously, in a single overall approach, with the question of the electronic equivalent of an original and that of electronic equivalents for the transfer of rights by means of negotiable instruments.

With the tradable sector neutralized and the non tradable sectors maxed out, the economy lacks sufficiently powerful growth engines.

The tradable sector accounts for just 30 of the US economy (by value added), and employment growth in the tradable sector is negligible.

The law should provide that a security right in a negotiable document and the goods represented thereby is subject to the rights under the law governing negotiable documents of a person to whom the negotiable document has been duly negotiated.

But there is a much better strategy than tradable permits.

The problem here is with the negotiable bill of lading.

As a result, the large non tradable sector and the domestic demand portion of the tradable sector cannot serve as engines of growth and employment.

The US tradable sector is growing.

Meanwhile, the non tradable side should grow.

And yet, given that the non tradable sector is constrained by its reliance on domestic demand, recovery if it comes will depend on the tradable sector s growth potential.

If employment growth in the non tradable sector dominated by government and health care falters, the tradable sector will have to take up the slack.

The speed of structural adjustment is also strongly influenced by how easily employment can shift from an economy s non tradable to its tradable side and across segments of global supply chains.

While the appreciation of the real s exchange rate kept a lid on prices for tradable goods, non tradable goods, especially services, remained a source of inflationary pressure.

The recommendations on negotiable instruments, independent undertakings and negotiable documents appear within square brackets as the Working Group has not decided yet that those types of asset should be addressed in the Guide.

It becomes very portable.
