The Committee urges the State party, in accordance with rule 112, paragraph 5, of its rules of procedure, to inform it, within 90 days from the date of the transmittal of this decision, of the steps taken in response to the decision expressed above.

While under its established guidelines for the transmittal of claim files to Iraq for comments, the Panel may draw an adverse inference against claimants who object to the transmission of their claim files to Iraq, the Panel did not do so in this case.

12.35 Concerning his transmittal of information supplied in the context of the article 22 process to non governmental organizations, counsel argues that at the time he saw no obstacle to doing so, neither the Convention nor the Committee's rules proscribing, in his view, such a course.

In pursuance of rule 112, paragraph 5, of its rules of procedure, the Committee requests the State party to inform it, within 90 days from the date of the transmittal of this decision, of the steps it has taken in response to the Views expressed above.
