The majority of the claims in the fourthsecond group of overlapping claims were filed by an E4 claimant and an individual claimant who was a shareholder of the E4 claimant company.

The business loss page of the individual claimant was completed in the name of an E4 claimant, and the individual claimant had originally provided documents indicating a connection between him and the company.

Both the Kuwaiti claimant and the Palestinian claimant were interviewed during the technical mission to Kuwait in 2004 and each claimant was asked to comment on the assertions and evidence submitted by the other.

With respect to the remaining claim, the only evidence provided by the claimant to prove his authority to file a claim on behalf of the company was a business card describing the claimant as Executive Director Partner and a lease in the name of three individuals who the claimant described as the corporate shareholders.

In the first set of competing claims, a Palestinian claimant and a Kuwaiti claimant filed separate claims in categories D and C respectively for the losses of the same car repair business in Kuwait.

The E4 claimant Al Nuwaisib Building Requirement was originally considered in the eighteenth instalment of E4 claims where it had been considered as overlapping with a category C claim filed by a different individual claimant.

Accordingly, in each case where a claimant seeks an award to undertake compensatory restoration, the Panel has considered whether the claimant has sufficiently established that primary restoration has not or will not fully compensate for the losses.

In many instances, the claimant asserted a 100 per cent beneficial interest in the company.

The Panel considered the evidence originally provided by the individual claimant and his subsequent responses.

The Governing Council approved this recommendation and the award was paid to the Kuwaiti claimant.
