In addition, it is safe to assume that the present class of treaties include bilateral investment treaties.

China, for example, had signed many BITs, but no investment cases had been brought against it.

It was indicated that there were remedies and techniques that developing countries could use to avoid investment disputes, with the need for definitions of investments in BITs being stressed as an important factor.

Other techniques included the exclusion of protectorate territories, which were often locations for avoiding the scope of application of BITs as far as tax was concerned.

Both BITs and double taxation treaties registered rapid growth rates during the period of 1995 2001 (which, however, have slowed down since then).

In general, those countries lacked the technical capacity and expertise to participate effectively in international negotiations on investment treaties and to implement the latter.

Developing country governments have also increased the number of concluded bilateral investment treaties (BITs) and double taxation agreements and, more recently, bilateral and regional free trade and investment agreements.

The risk of litigation has also increased, especially because of a lack of collective representation mechanisms, the presence of vulture investors or the legal implications of bilateral investment treaties.
