The Counter Terrorism Committee has considered the report carefully, with the assistance of its experts, and has written to the Permanent Representative of Jamaica to the United Nations to set out its preliminary comments.

The experience of the Commonwealth countries, which were confronted with similar challenges, would be most relevant and would provide the Jamaicans with a reference to help decide which option is best suited for them.

Viet Nam associates itself with the statements made by the Permanent Representative of Malaysia on behalf of the Non Aligned Movement and by the Permanent Representative of Jamaica on behalf of the Group of 77 and China.

9.2 The Committee notes that the Supreme Court of Jamaica has, in recent cases, allowed applications for constitutional redress in respect of breaches of fundamental rights, after the criminal appeals in these cases had been dismissed.

The Permanent Mission of Jamaica to the United Nations presents its compliments to the Chairman of the Security Council Committee established pursuant to resolution 1540 (2004), and has the honour to forward the report by the Government of Jamaica in accordance with paragraph 4 of the aforementioned resolution (see annex).

Earlier this year, at the height of the exodus of Haitian boat people, the Government of Jamaica, out of humanitarian concern for their plight, signed a memorandum of understanding with the Government of the United States to allow for the operation of a processing facility within Jamaica apos s territorial waters.
