While he could agree on ruling out the former, he was against ruling out the expanded core document.

Mr. Kälin said that Mr. Amor's paper, while reflecting the Committee's position, did so too harshly.

Mr. Kälin said that the Committee could decide to follow the procedure it had employed in the case of the United States of America to write to the Government of the Sudan, requesting it to submit its overdue report within a specific deadline.

Mr. Kälin asked whether single report meant one report for all the committees or an expanded core report.

She suggested requesting a special report from the Government of the Sudan, identifying the articles proposed by Mr. Kälin, Mr. O'Flaherty and Mr. Shearer.

Accordingly, in September 2004, the Secretary General appointed Walter Kälin as his Representative on the human rights of internally displaced persons.

Mr. KÄLIN commended the reporting State for the early submission and detailed content of its fourth periodic report.

At the 43rd meeting, the Representative of the Secretary General on the human rights of internally displaced persons, Mr. Walter Kälin, introduced his report (E CN.4 2005 84 and Add.1).

Mr. Kälin supported by Mr. O'Flaherty, said that it was difficult to discuss selectivity during the last hour of the session, and the Committee should take it up at a later date.

Mr. Kälin said that the Human Rights Committee had always stressed the protection of the rights of women against gender based violations and trafficking.

Mr. Kälin, while taking note of the delegation's replies to questions 19 and 20 on the list of issues, concerning terror suspects, suggested that the text of the relevant provisions should be submitted to the Committee.

The meeting report (HRI MC 2004 3) contained a number of very positive proposals for the reform of the Committee's reporting requirements, as did the proposals of Mr. Kälin, Mr. Rivas Posada and the Working Group.

The Special Rapporteur on new communications, Mr. Martin Scheinin until the end of the eighty second session, and Mr. Walter Kälin since then, continued his functions during the reporting period.

Mr. Kälin said that, while nobody expected Mauritius to become a major destination for refugees, it was clear that even small countries were now faced with asylum seekers who claimed that they might suffer persecution if they were sent back to their countries of origin.

Mr. KÄLIN said he looked forward to any reforms which would reinforce the human rights implementation system but stressed the need for dialogue with stakeholders, including the Human Rights Committee, if such reforms were to succeed.

He associated himself with the suggestions made by Mr. Kälin and added that any reform should seek to strengthen underused mechanisms such as the country missions undertaken by the Committee against Torture and the Committee on the Elimination of Discrimination against Women, early warning procedures and emergency measures.

Mr. KÄLIN said he had been pleased to read in the delegation's written replies that Italy accepted that the Covenant applied to persons under its jurisdiction in cases where Italian troops or police officers were stationed abroad (question 2).

Mr. Kälin (Representative of the Secretary General on the human rights of internally displaced persons), introducing his report (A 60 338), said that his activities were based on the Guiding Principles on Internal Displacement, which clearly underlined that States had the primary duty to provide protection and assistance to internally displaced persons.
