The Mandate of the Working Group on ERW

on Explosive Remnants of War (ERW)

Mauritius is also in the process of amending its Explosives Act so as to cater for its obligations under the Convention on the Marking of Plastic Explosives for the purpose of Detection.

The Working Group on Explosive Remnants of War heard a presentation by France on The French Matrix on Methodology .

As for legal measures on explosives, their import and sale are governed by a State monopoly granted to the Ministry of Mines, Energy and Hydraulics (MMEH).

These systems and the type of methodology outlined above are currently utilized by coalition forces to focus their ERW efforts.

In accordance with the mandate of the Working Group on ERW, the Chair proposed that the Meetings of the Military and Technical Experts discussed the following questions

On the ground, in Netanya, on 12 July, a young Palestinian strapped with explosives detonated himself at the entrance of a shopping mall.

The 2003 Meeting of the States Parties to the CCW adopted the following mandate for the Working Group on ERW for the year 2004

2003On 12 May 2003, suicide bombers rammed a truck loaded with explosives into a Russian government compound in Znamenskoye, northern Chechnya, killing 59 people.

While Australia's commitment in this area is small its technicians are placed in the key coalition agencies dealing with ERW.

The production is also notorious for the cruelty to animals that occurred both on screen and on site, including deliberately killing a horse with explosives.

The Protocol on Explosive Remnants of War has provided a partial remedy to reduce the dangers of ERW (including unexploded submunitions) after the end of the fighting.

9. Emphasizes the importance of universalization of the Protocol on Explosive Remnants of War (Protocol V), and welcomes the commitment of States parties to the Protocol to the effective and efficient implementation of the Protocol

Protocol V, which includes clean up obligations, also covers corrective measures to be taken following a conflict so as to reduce the risks and impacts associated with explosive remnants of war.

(i) We propose a final target date for delegation submission of IHL questionnaire responses to the ERW Coordinator of 13 January 2006

It also addresses related issues such as exchange of information, assistance and cooperation which were part of the work on ERW during the course of 2004.

Part of the Australian Government ERW mandate for this GGE is the fostering of the exchange of information regarding International Humanitarian Law principles and application.

On August 22, 2007, a safe house wired with explosives was destroyed in the city, believed to have been an arms cache as well as a launching point for mortars that had targeted the police station in Karma.

France supports and actively participates in the work being carried out on ERW within CCW to enable specific preventive measures destined for inclusion in Protocol V to be introduced.

Recalling with satisfaction the adoption of the Protocol on Explosive Remnants of War (Protocol V) at the Meeting of the States Parties held at Geneva on 27 and 28 November 2003

(x) International organizations undertaking a critical analysis of the McCormack report will be asked to generate a report of their analysis for submission to the ERW Coordinator by 24 February 2006

(viii) Professor McCormack will be asked to deliver a report of his analysis to the ERW Coordinator (hereinafter the McCormack report ) by 10 February 2006

Protocol V to the CCW on ERW is a good example of how these fundamental IHL principles can be applied. The requirement to remove ERW and to provide assistance for the removal of these weapons and to take other measures to reduce the threat to civilians accords with the principle to avoid unnecessary suffering.

In this way it supports the efforts being carried out on the improvement of all munitions within the context of the implementation of Protocol V on explosive remnants of war efforts to which it contributes directly, actively and constructively.

Organizations undertaking such an analysis shall be asked not to share the contents of the McCormack report or any supporting documentation with any third party, but instead shall submit their analyses to the ERW Coordinator.

Based on Section 24 paragraph 3 of the aforesaid law, the envisaged amendment of Decree No. 71 1988 Coll. on Explosives as amended will define detection agents that will be in conformity with Part 2 of the Montreal Convention Detection Agents.

9. Expresses support for the decisions of the Group of Governmental Experts to recommend to the Third Review Conference a plan of action to promote universality of the Convention and the Protocols thereto, a declaration on the entry into force of Protocol V on explosive remnants of war, as well as a sponsorship programme

Welcoming the entry into force of the Protocol on Explosive Remnants of War to the Convention on Prohibitions or Restrictions on the Use of Certain Conventional Weapons Which May be Deemed to Be Excessively Injurious or to Have Indiscriminate Effects (Protocol V),See CCW MSP 2003 3, annex V, appendix II.

(vi) So that he may commence his analysis in a timely fashion, questionnaire responses and transcribed interventions currently in the possession of the ERW Coordinator shall be forwarded to Professor McCormack following the conclusion of the November 2005 session

But appeasement is not one of the lessons. We will not make our free societies safe by bombing ISIS with strong nouns and weak verbs rather than high explosives.

That is to say, they will be analyzed for the purpose of identifying general trends with the overall aim of establishing a baseline or baselines from which further discussion can proceed in accordance with step three of the ERW Coordinator's three step approach. There shall be no State or delegation attribution during the course of this analysis and generation of any report for subsequent use by the GGE

With regard to explosives, there are two scenarios one where they are seized and or held by separate civil authorities as being of illicit origin and are destroyed in order to avoid accidents and another where they are used for clearly defined purposes which are subject to the security measures described in the preceding paragraph.

(xi) The McCormack report and any subsequent constructive critical analyses shall then be provided by the ERW Coordinator to all delegations for review and for the preparation of comments to be presented during the CCW GGE session to be held from 06 10 March 2006.
