59. As soon as possible after receiving the request and turning down a request for postponement, the Court held a hearing at which both Parties presented their observations.

Concerning the repeated postponements of the hearing of the case until 5 May 1989, the State party contends that they must be attributed to the author apos s requests for a competent legal representative, charged with his defence.

The waiver provision most resorted to was rule 110.19 (d) and (h), which applies if the exigency of the service does not permit the delay or if bidding will not give satisfactory results.

2.7 Prior to the reconsideration of this matter in the District Court on 15 October 1998, the author's lawyer had filed a motion requesting an adjournment, as the author was ill and unable to travel, and his lawyer could not represent him on the date in question.
